Craft, Executive Director State Agriculture Development Committee Date: June 23, 2008 RE: Preliminary Conditional Approval of Planning Incentive Grant Applications The State Agriculture Development Committee (SADC) at its May 22nd meeting issued preliminary conditional approvals to the 15 county and 37 municipal applications submitted under the FY09 County and Municipal Planning Incentive Grant (PIG) round. This action means that counties and municipalities may begin submitting individual farm applications to the SADC for green light approvals pursuant to N.J.A.C. 2:76-17.9 and 2:76-17A.9. In accordance with Procedure #1 of the implementation details adopted in September (attached), the SADC will review individual farm applications to ensure farms meet all criteria, that housing opportunities, exception areas and subdivision requests comply with SADC standards, and that any appraisal issues have been identified and are fully understood. A green light approval will enable a county and/or municipality to proceed with appraisals. The SADC, however, will not certify easement values on any farm until all conditions in its resolution granting conditional preliminary approval to the county or municipalitys PIG application are satisfied. These include a determination by the SADC that all components of the comprehensive farmland preservation plan and project area summaries have been fully addressed and are complete, and SADC certification of any necessary county agricultural development area (ADA) amendments. We expect the Committee to consider ADA amendment certifications at its June and July meetings. The SADC will formally notify counties and municipalities when all conditions of approval have been adequately addressed. Once a value has been certified, the landowner has accepted an offer and the county and/or municipality has granted the project final review/approval, SADC final approval may be requested in accordance with Procedure #2 of the implementation details adopted in January. The SADC approved its FY09 appropriation request, including funding for the county and municipal PIG programs, at its May 22nd meeting. It includes a $2 million base grant for each county participating in the new county PIG program and a $15 million competitive grant fund, with each county eligible to receive a maximum of $5 million (base grant and competitive fund combined). For municipalities, the recommended allocation is $750,000 each. Please be aware that funding eligibility is subject to approval of the Garden State Preservation Trust, legislative appropriation of funds and the Governors signature of the respective appropriation bills. We are uncertain, however, when the Garden State Preservation Trust will take action on that request. We will keep you updated on the status of funding availability as that develops. It is clear that you have put a great deal of hard work into laying the solid foundation necessary to succeed in our planning incentive grant programs.
