New Jersey Department of Transportation (NJDOT) requirements for annual cost submissions by architectural and engineering consultants are based on Article 58 of the Standard Terms and Conditions of Agreement between State and Consultant (pdf 455k). There are separate requirements to classify whether a consultant is exempt or non-exempt:

• Consultants with less than $50,000 in NJDOT direct labor incurred in any one fiscal year on cost plus fixed fee contracts.

Non-exempt consultants

• Any firm that does not fall within the categories above is considered non-exempt.
